Desde seus primórdios de ocupação portuguesa há relatos de cultivo de videira e elaboração de vinhos. O objetivo do presente artigo é traçar um panorama sobre esta história. Como metodologia para realizar esta pesquisa, foi efetuada uma busca no banco de dados oficial da legislação existente sobre o tema no Brasil, tanto a vigente como aquela do acervo histórico. Neste, retornaram 216 normas, às quais foram acrescidas aquelas com relação direta ao setor, mas que não mencionavam em sua ementa ou palavras-chaves o termo “vinho”. Com o objetivo de sistematizar o texto e melhor compreender o contexto em que cada norma for elaborada, utilizou-se como parâmetro o estudo realizado por Tonietto e Mello (2001), que apresenta os Períodos Evolutivos da Vitivinicultura Brasileira e auxiliou na divisão dos períodos históricos trazidos no presente artigo. Assim, apresentam-se quatro períodos históricos do direito do vinho no Brasil: de 1808 a 1930; de 1930 a 1964; de 1964 a 1988; e de 1988 até o presente. Como resultado, verifica-se uma substancial evolução tanto na vitivinicultura em si quanto nas normas que regulam este setor. The history of Brazilian Wine Law, or the regulation of Brazilian winemaking, follows the history of Brazil as a colony, empire and republic. From its beginnings of Portuguese occupation, there are reports of grape cultivation and elaboration of wines. The purpose of this article is to outline this history. As a methodology to conduct this research, a search was made in the official database of existing legislation on the subject in Brazil, both in force and in the historical collection. In this, 216 rules returned, to which were added those with direct relation to the sector, but that did not mention in its menu or keywords the term "wine". In order to systematize the text and better understand the context in which each standard is elaborated, the study by Tonietto and Mello (2001), which presents the Evolutionary Periods of Brazilian Vitiviniculture, was used as a parameter and assisted in the division of historical periods brought in this article. Thus, four historical periods of wine law in Brazil are presented: from 1808 to 1930; from 1930 to 1964; from 1964 to 1988; and from 1988 to the present.
